Tezzbuzz Desk – West Bengal Chief Minister and Trinamool Congress supremo Mamata Banerjee has suffered a major setback in the assembly elections. Along with the defeat from Bhawanipur seat, his party All India Trinamool Congress (TMC) has also faced a crushing defeat.
After the election results, Mamata Banerjee clearly said that she has not lost, but “votes have been looted.” She also announced that she would not resign from the post of Chief Minister. After his statement, the stir in the politics of West Bengal has intensified.
Suvendu Adhikari said – everything is written in the constitution
BJP leader Suvendu Adhikari, who defeated Mamata Banerjee from Bhawanipur seat, reacting to this statement said that everything is clearly written in the Constitution.
He said, “I don’t need to say much. Whatever has to happen will happen as per the Constitution.”
BJP MP said – insult to the Constitution
BJP MP Raju Bista reacted sharply to Mamata Banerjee’s statement. He said that if the former Chief Minister publicly says that she will not resign, it is an insult to the Constitution of India.
He said, “Mamata Didi has disrespected the Constitution many times before, but this time the people’s mandate has clearly gone against her. She is insulting not only the Constitution but also the people of Bengal.”
Raju Bist also said that West Bengal has now moved ahead and is walking on the path of development under the leadership of Prime Minister Narendra Modi.
TMC MP said – there is no question of resignation
On the other hand, TMC MP Kalyan Banerjee defended Mamata Banerjee, saying that the Model Code of Conduct was in force for the last three months, so she was not already actively in the role of Chief Minister.
“When the government was administratively run through the Chief Secretary, the question of resignation did not arise,” he said.
Kalyan Banerjee also raised questions on the election process and alleged that there was “theft” during the counting. He said the counting agents were attacked and taken out by the CISF and CRPF, posing a major threat to democracy.
Former bureaucrat explained the constitutional side
Former bureaucrat Jawhar Sircar said that as soon as the tenure of the assembly ends, the assembly is automatically dissolved and the process of forming a new government begins.
He said that the Election Commission finalizes the results and sends them to the Assembly, after which certificates are issued to the new MLAs and the way is cleared for the formation of the new government.
Retired judge said – there is no problem even if you do not resign
Retired Justice Debasish Kar Gupta also said on this issue that under Article 164 of the Constitution, the Governor administers the oath to the Chief Minister.
He said that after the election results, the tenure of the old cabinet ends, but as per tradition, the old Chief Minister can be made the caretaker Chief Minister for a few days.
According to him, even if Mamata Banerjee does not resign immediately, a constitutional crisis will not arise because further decisions fall within the jurisdiction of the Governor.
Tension increased in Bengal politics
Mamata Banerjee’s statement “I will not resign” has further heated up the politics of the state. The opposition is calling it an insult to the mandate, while TMC is considering it to be the result of irregularities in the electoral process.
