Dhurandhar The Revenge: In early April, Trimurti Films had filed a copyright infringement case against Aditya Dhar’s B62 Studios and Super Cassettes Industries Pvt. Ltd. This case was filed for using the song Tirchi Topiwale from the 1989 film Tridev in Dhurandhar The Revenge without permission. Now Delhi High Court has given permission to the filmmakers to release this film on OTT with the song Rang De Lal.

Why was the approval given?

According to PTI, the Delhi High Court rejected the petition of Tridev’s producer Trimurti Films, which had sought a ban on streaming Dhurandhar The Revenge on the OTT platform. In this petition, there was also mention of the song ‘Tirchi Topiwale’ which was allegedly used without permission. In the order issued on May 14, the court said that the film was released in theaters with the same song on March 19, hence banning its OTT release would ‘create an awkward situation’ and would be ‘incomprehensible’.

T series will have to pay Rs 50 lakh

The High Court also said that if Trimurti Films is successful in proving its case, then it can be given appropriate compensation. Super Cassettes are commonly known as T-Series. In the court he was asked to deposit Rs 50 lakh in the court within four weeks. The High Court also said that the filmmakers have invested a lot of money, time and effort in the film based on the agreement made with T-Series, hence they cannot be put in any kind of ‘disadvantageous situation’.

Tridev’s songs were remixed earlier also

The High Court also took note of the fact that T-Series had used and promoted Tridev’s songs by including them in the remix versions of its previous two films. He had also claimed to have full rights on the song Tikri Topiwale. However, no action was taken on this at that time. The court said that it cannot direct them to suffer huge financial loss merely at the behest of the plaintiff. That too, when the plaintiff decides to wake up from his deep sleep. Let us tell you that in April, the Delhi High Court had sent the dispute over the song ‘Tridev’ for mediation, but till May, the mediation talks between the two parties failed. After this, Delhi High Court has ordered to release the film with songs and T-Series to deposit Rs 50 lakh in the court.
