The troubles of many big leaders of the party, including Delhi Chief Minister and Aam Aadmi Party (AAP) national convenor Arvind Kejriwal, have increased once again. Taking a very tough stand, the double bench of Delhi High Court on Tuesday served contempt of court notices to Arvind Kejriwal, Manish Sisodia, Sanjay Singh and other senior AAP leaders. The High Court itself has taken this big action ‘suo motu’.
All these senior leaders are facing very serious allegations of allegedly making “defamatory, objectionable and derogatory” comments on social media and other platforms against Delhi High Court sitting judge Justice Swarn Kanta Sharma. After this strict stance of the court, there is a stir in the camp of Aam Aadmi Party.
Know after which order this big action started and what the court said?
While hearing the case, the double bench of Justice Naveen Chawla and Justice Ravinder Dudeja made it clear that this entire proceeding has been initiated on the basis of an old order dated May 14. In fact, on May 14, the court of Justice Swarn Kanta Sharma itself had admitted that ‘AAP’ leaders had directly hurt and insulted the dignity of the court through social media posts.
The double bench of the High Court said in its order that the single bench of Justice Sharma has taken in-depth cognizance of the social media posts, electronic records and materials published in newspapers made by these leaders. Along with this, the court has given strict instructions to its registry that copies of all digital and written records to this case should be kept completely safe and they should be presented before the court on the next hearing.
Amicus Curiae will be appointed to help the court, next battle will be on 4th August
According to a report by the famous legal website ‘Bar and Bench’, the High Court bench has issued notices to all these leaders accused of contempt and clearly instructed them to file their written reply in the court within the next four weeks. In this serious legal dilemma, the court also said that an impartial ‘Amicus Curiae’ (assistant of the court) will also be appointed to understand the nuances of the case and assist the court.
The next hearing of this high-profile case has now been fixed for August 4. The most surprising thing is that during the entire court proceedings on Tuesday, no lawyer appeared in the court to represent Arvind Kejriwal or any other accused AAP leader.
Why did Kejriwal and AAP leaders boycott Justice Sharma’s court?
The roots of this entire controversy are a little older. In fact, earlier, Arvind Kejriwal, Manish Sisodia and Durgesh Pathak, who were involved in the Excise Policy (Delhi Liquor Scam) case, had made an official demand to Justice Swarn Kanta Sharma to recuse themselves from hearing the case. He wanted his sensitive case to be transferred to another bench. But on April 20, Justice Sharma had completely rejected his strange demand.
In that historic order, Justice Sharma had bluntly said that no politician of the country can be given free rein to create an atmosphere of distrust and doubt among the public against the judiciary. Making a scathing comment, the court had also said that insisting on changing the judge as per one’s choice or removing the judge from the case is like putting the entire judiciary in the dock, which is completely wrong.
After trolling on social media, High Court took this big and tough decision
According to the Double Bench, just before and after Justice Sharma’s order, many derogatory posts were continuously posted against the judge on social media by AAP leaders and their supporters. Seeing the waters rising above his head, Justice Sharma took the tough decision to initiate direct contempt proceedings in this case.
In his detailed and written order, Justice Sharma has also specifically mentioned the secret letters written by Arvind Kejriwal, Manish Sisodia and Durgesh Pathak, in which these leaders had talked about completely boycotting the judge’s court proceedings. Apart from this, the court has also taken cognizance of the video released by Arvind Kejriwal, in which he was explaining to the people of the country his personal reasons for not appearing in Justice Sharma’s court. Now these videos and statements together have created a new problem for Kejriwal and Company.
