The cases of cyber stalking and harassment through social media are continuously increasing in the country. Even the courts seem to be more strict regarding these matters than before. Meanwhile, Rajasthan High Court has given a decision which is now being discussed in the entire country. The court granted bail to an accused of cyber stalking but also banned him from using social media for a whole year. Usually, courts do not impose such restrictions, but the Rajasthan High Court has made non-use of social media a major condition for bail.
The court clearly said that if the accused is caught using social media under any name or fake ID during this period, his bail will be canceled immediately. The court has given this decision amidst increasing cases of cyber stalking.
What is the whole matter?
This case is to a minor girl. The girl’s father had filed a complaint in this case. The allegation was that during the month of February, the accused was continuously stalking the girl through social media, harassing her and sending her wrong messages on social media itself. The girl’s father initially tried to convince the boy in this matter but later took legal action through the police.
On the complaint received from the girl’s father, the police had registered a case in this matter under several sections including cyber stalking and POCSO Act. After this the police arrested the accused and interrogated him. Along with this, messages sent through social media were also examined. After completion of the investigation, the charge sheet was also presented in the court.
conditions imposed on bail
During the hearing, it was argued in the court that the investigation has been completed, the charge sheet has been filed and now there is no need to interrogate the accused. The defense also said that the accused has been falsely implicated and he will cooperate fully in the trial. On the other hand, the victim’s family and the government lawyer told the court that the actions of the accused have badly affected the mental condition of the girl. It was also stated before the court that the constant contact and harassment through social media affected the normal life of the victim.
Rajasthan High Court granted bail to the accused but also imposed many strict conditions. The court said that the accused will not contact the victim or her family. He will not send any message through any medium like Instagram, Facebook, Snapchat, WhatsApp. Not only this, the court has banned the use of social media platforms for one year.
Terms become subject of discussion
After this decision of the High Court, it is now being discussed in the entire country. Legal experts believe that this decision can become an example in the future. In fact, courts have now started recognizing that digital platforms are not just a medium for communication, but are also becoming new avenues of crime. Cases of cyber stalking, online threats and mental harassment are increasing continuously, especially against women and minors.
