In the famous Bharat Bhushan Tiwari death case of Bhojpur, Bihar Human Rights Commission has taken important steps towards providing relief to the victim’s family. In fact, the Commission has said that the family should get interim assistance on humanitarian grounds without waiting for the completion of the final investigation. For this reason, instructions have been issued to the state government to give appropriate ex-gratia compensation to the parents of the deceased.
In fact, during the hearing, the post mortem report was also placed before the Commission. According to the report, Bharat Bhushan Tiwari died due to excessive bleeding and shock after being shot. Taking this report on record, the Commission said that the cause of death is clear, but the investigation of the entire matter is still going on. Therefore, it would not be appropriate to reach any final conclusion at this stage. The commission also said that after the completion of the investigation, further decisions will be taken on the basis of all the facts.
What instructions were given to the government in the BHRC order?
At the same time, Bihar Human Rights Commission has given additional time of two weeks to the state government to file a detailed reply during the hearing. It was told by the government that a complete report to the matter is being prepared, hence some more time is required. While accepting this request, the Commission has directed to submit a detailed report by the next hearing.
Recommendation to provide interim relief to the victim’s family
In fact, the Commission also mentioned Section 18(C) of the Human Rights Protection Act, 1993 in its order. Under this, the Commission said that it is recommended to provide interim relief to the victim’s family. It was also made clear that this compensation does not mean that the state government has accepted any kind of legal responsibility or mistake. The Commission says that interim assistance is being given only on humanitarian grounds, while the investigation and legal process of the case will continue as before. The government will now have to present its detailed stand before the Commission along with the progress of the investigation, available evidence and other necessary information.
What will happen next in Bharat Bhushan Tiwari death case?
Along with this, the Commission said that the judicial inquiry into this entire matter is also going on. This investigation is being conducted under the chairmanship of a former judge of Patna High Court. For this reason, the Commission said that it would not be appropriate to reach any conclusion before the investigation is completed, because it could affect the investigation process. The Commission wants that the final decision should be taken only after all the facts are revealed. The next hearing of the case has been fixed for August 3, 2026.
