RC Transfer Process: Selling an old car after buying a new car has become a common thing these days. But many people make a big mistake after selling the car, due to which e-challans start coming on their mobile even after months. Not only this, if the sold vehicle meets with an accident or violates traffic rules, the old owner may also have to face legal problems. It has been observed that while selling the car, most of the people take the money and hand over the keys to the new owner but do not complete the process of RC transfer which is also called Ownership Transfer. In such a situation, the owner of the vehicle remains the old person in the government records and all the challans are issued in his name.
Do these important things first while selling a car
Regarding this, experts say that preparing delivery note is the most important step while selling a vehicle. It should contain the date, time of handing over of the vehicle and signatures of both the buyer and the seller. Along with this, get the buyer’s signature on Form 29 and Form 30. In future, if the vehicle is involved in an accident or major traffic violation, these documents will help in proving that the vehicle was not in your possession at the time of the incident.
Must inform RTO within 14 days
It is said that under the Motor Vehicle Act, after selling the vehicle, it is not only the responsibility of the buyer but also the seller to give written information to the concerned RTO within 14 days. For this, collect a copy of the sales documents, delivery note and transfer form and keep its receipt safe with you. This starts the process of vehicle transfer in the RTO records and future legal risks are reduced to a great extent.
If you receive a challan by mistake, complain like this
Along with this, there is no need to panic if an e-challan is issued in your name before the RC transfer is completed. You can lodge a complaint by visiting the official e-Challan portal of the government. In such a way that while complaining, clearly state that the vehicle has already been sold. Also, a copy of the delivery note, sales receipt and buyer’s identity card has to be uploaded as proof. In view of this, after investigation the traffic department can transfer the challan in the name of the right person.
Let us tell you that just taking money after selling the vehicle is not enough. If the documentary process is not completed on time, the responsibility for future challans, legal notices and situations like accidents may also fall on the old owner.
