The Kerala High Court has taken a strict and decisive step to curb unauthorized legal practice in the state. In a major directive aimed at maintaining professional standards within the judiciary, the High Court has ordered the Bar Council of Kerala to publicly release the names of 1,157 advocates enrolled between 2010 and 2021 who have been practicing without clearing the All India Bar Examination (AIBE) or possessing a valid Certificate of Practice (COP).
Division Bench Directives on Uncertified Practice
A division bench comprising Chief Justice Soumen Sen and Justice V.M. Shyam Kumar issued the strict order, mandating that the complete list of these 1,157 advocates be published prominently on the official websites of both the Bar Council of Kerala and the Kerala High Court.
To ensure immediate enforcement, the court issued explicit instructions to the court registries and judicial officers:
Restriction on Filing: The registrar of relevant courts has been directed not to register any new cases or matters where a kazalatnama has been filed by any advocate featured on this list.
Case File Entries: If any of these uncertified advocates have already filed a kazalatnama in ongoing cases, the Registrar must make an appropriate formal entry in the case file. This ensures that the bench hearing the specific case remains fully aware of the advocate’s unauthorized practice status.
Pathway for Rectification and Compliance
While taking a firm stance against non-compliance, the High Court also provided a clear framework for advocates seeking to rectify their professional standing. The bench clarified that the names of advocates can be successfully removed from this restrictive list if they subsequently clear the requisite examinations, obtain a valid Certificate of Practice, and submit an authenticated copy of the certificate to the competent authorities.
This judicial crackdown highlights the judiciary’s unwavering commitment to upholding professional integrity and ensuring that only qualified legal practitioners represent litigants in courts of law.
