What happened in the High Court?

WhatsApp told the Delhi High Court on Wednesday that if it is asked to break the encryption of messages, the messaging platform will be destroyed. Advocate Tejas Karia, appearing for American company Meta, said that people use this platform because it ensures privacy and because the messages exchanged on it are end-to-end encrypted. .

Curia told a bench of Delhi High Court Acting Chief Justice Manmohan Singh and Justice Manmeet Pritam Singh Arora that Tejas said that as a platform, we are saying that if we are asked to break encryption, then the importance of WhatsApp is lost. Will be done.

In fact, the Delhi High Court was hearing petitions filed by WhatsApp and Facebook (now known as Meta) challenging Rule 4(2) of the Information Technology (Intermediary Guidelines and Digital Media Conduct Code) Rules, 2021.

Rule 4(2) states that a significant social media intermediary must be able to identify the first source of information on its computer resource when an order to that effect is passed by a court or competent authority.

Meta's lawyer Tejas Karia told the court on Wednesday that under this provision, WhatsApp will have to store millions of messages for many years, which does not exist anywhere else in the world. He said that we have to keep a complete series and we do not know which messages will be asked to decrypt. This means that millions of messages will have to be stored for many years.

Meta's counsel further asserted that the rule under challenge goes beyond the basic Information Technology Act, which does not provide for breaking encryption. The court asked Meta's lawyer whether a similar law existed anywhere else in the world. Have these matters been raised anywhere in the world? Meta's lawyer Tejas Karia replied, "No, not even in Brazil." During the hearing, Kirtiman Singh, appearing for the central government, argued that people know what can happen on social media and the idea behind the rule is to trace the source of the message. Ultimately, there should be some mechanism to trace the messages because it is the need of the hour and WhatsApp has faced some very difficult questions before the United States Congress. The court said that there is a need to create a balance. The court will next hear the case on August 14 with petitions challenging various provisions of the IT Rules 2021.
