Big order of Delhi High Court, Amicus will be appointed for Kejriwal, Sisodia and Durgesh Pathak

Justice Swarn Kanta Sharma has given a big order in a case going on in Delhi High Court. The court has decided to appoint amicus curiae for former Chief Minister Arvind Kejriwal, former Deputy Chief Minister Manish Sisodia and leader Durgesh Pathak in the case to them. The court said that three senior advocates will be appointed to present arguments on behalf of the three leaders, who will present their case before the court.

During the hearing, the court asked which defendants had not appeared in the court. On this, Solicitor General Tushar Mehta said that Kejriwal, Sisodia and Durgesh Pathak have not appeared in the court. After this, Justice Sharma directed that a senior advocate be appointed as amicus curiae (friend of the justice) to present the arguments on behalf of these three, so that the legal case can be effectively presented on their behalf. The court also said that CBI’s arguments will be heard only after this process.

A defendant’s ‘right of reply waived’

The court said that the arguments of the Central Bureau of Investigation (CBI) will be heard only after the appointment of amicus on behalf of former Chief Minister Arvind Kejriwal, Sisodia and Durgesh Pathak. During the hearing, the court was also informed that one of the defendants had not yet filed his reply. On this, the bench took a strict stand and said that the right of that party to file a reply is terminated. The court has adjourned further hearing of the case till Friday.

Why did Kejriwal-Sisodia not send a lawyer?

The hearing of the case to the alleged liquor scam is going on in the High Court, in which the CBI has challenged the decision of acquittal given by the trial court to 23 accused including former Chief Minister Arvind Kejriwal. This case is being heard in the court of Justice Swarn Kanta Sharma. Meanwhile, a demand was also made by Kejriwal to transfer the case to another judge, which was already rejected by the Chief Justice of the High Court. After this, Kejriwal filed a recusal petition, in which he raised questions about the impartiality of the judge and said that he does not expect to get justice in this case. During the hearing in the case, the trial court’s decision was challenged by the CBI as well as there was a heated debate between the parties regarding the legal process. The court has also issued several procedural instructions taking the proceedings forward.

According to the information, the court clarified on the objections raised by Kejriwal that the hearing will be conducted by Justice Swarn Kanta Sharma only. After this, the three leaders wrote a public letter declaring that neither they would appear in the court themselves nor would any lawyer present arguments on their behalf. Kejriwal in his letter alleged conflict of interest, claiming that the judge’s family members have links with the panel of government lawyers and the SG plays a role in the case allocation process. He says that for this reason he does not expect a fair trial.
