Railways: Is it permissible to carry a bottle of alcohol during train travel? What does the law say?

A common question among train travelers across India is whether carrying alcohol on a train is legal or not. This confusion is especially prevalent during festivals and holiday seasons. The railways consider trains to be public places and adhere to established rules to maintain passenger safety and order. However, the rules regarding alcohol are not directly governed by the railways, but rather by the excise laws of the respective states.

What the Law Says About Carrying Alcohol on Trains
The Railways Act of 1989 does not explicitly prohibit carrying alcohol. However, this does not mean that any passenger can travel with alcohol without restrictions. In reality, permission to carry alcohol on a train depends on the laws of the state where the journey originates. If alcohol is legal in the relevant state, then a passenger may carry it with them. Conversely, if the state has a ban on alcohol, then carrying it from or through that state can lead to legal action.

States Where Alcohol is Completely Prohibited
Some states and Union Territories in India have a complete ban on alcohol. These include Gujarat, Bihar, Nagaland, and Lakshadweep. In these regions, possessing, buying, or carrying alcohol is considered a legal offense. If a passenger is caught with alcohol during a train journey in these states, they can face strict action under the respective state's excise laws, regardless of where the train originated.

What are the Penalties for Breaking the Rules?
Under railway rules, violations related to alcohol can result in imprisonment for up to 6 months, a fine of ₹500 to ₹1,000, or both. In states where alcohol is completely prohibited, the penalties can be even more severe. This can include arrest, heavy fines, and a lengthy legal process. Therefore, passengers are advised to familiarize themselves with the alcohol laws of the relevant state before carrying alcohol on a train to avoid inadvertently getting into legal trouble.
